Two letters from the BIA were received today. Basically the BIA is refusing to recognize neither the former Follis Elected Council, nor the duly elected Miller Elected Council as legitimate leadership of the Modoc Nation. The lawyers for the Miller Elected Council are drafting proposals to the former Follis Elected Council to settle this issue once and for all. The story will be updated as new information comes to light.
June 14, 2022
Today when the Elected Council arrived at the Modoc Nation Headquarters for the hearing we were met with barricades and private security guards. The illegitimate former Elected Council did not show up to defend their actions. The hearing was moved to an alternate site and Modoc Nation Tribal Judge Jason Clark issued a Preliminary Injunction after hearing the facts of the case.

A Modoc Nation member who will not be named went in to see what corrections their file allegedly needed. They were told by Charlie Cheek they had to wait until the registrar contacted them. Charlie Cheek then tried to justify former Chief Bill Follis not having his membership questioned due to time in office. Time as a member was not supposedly legitimate proof for anyone else. In am even more heinous comment Charlie Cheek put the blame squarely on the shoulders of former Tribal Registrar and Modoc Elder, Jack Shadwick. Mr. Shadwick served the Modoc Nation diligently for years as Tribal Registrar, Ambassador, and Elected Council member, as well as overseeing Modoc Elder programs and making sure numerous Modoc Nation members were able to attend and graduated higher learning programs. It is disgusting that Charlie Cheek who is not even a Native American would slander a Modoc Nation elder inside our own headquarters.

The 2022 annual Tribal Council meeting & election of the Modoc Nation was held outside The Gathering Place. Modocs from all over the United States showed up to exercise their constitutional right to meet and vote. The results of the constitutional election are as follows:
Chief: Kirk Miller
2nd Chief: Ben Karnes
Councilmen: Edd Miller and Danny Burkybile
Secretary/Treasurer: Anita Williams
Tribal Judge: Jason Clark

A new memo dated April 26, 2022 has just been released to members. By the Elected Council’s own admission in it, every constitutional amendment and election since 2003 should be invalidated. The weird thing is is that they want us to wait for Chief Follis to sign off on enrollment after the audit, but he has already signed off on every enrollment. You really can’t make this stuff up.

The Elected Council has put out Resolution 22-17 a companion of sorts to the previously released Resolution 22-16. In this new resolution they have also amended the Election Ordinance. There is possibly some discrepancy to the date of this new resolution and amendment. They are both dated April 21, 2022, but it;s possible they weren’t actually done until April 25, 2022. Either way, the Elected Council has amended the Election Ordinance no more than sixteen days before the election is to be held. Both the new resolution and amendment are both irrelevant. All they do is remove the date of May 7, 2022 from the Election ordinance. The Election Ordinance and more importantly the Modoc Constitution still both clearly state that the election is to be held every for years on the first Saturday of May. This year that date is May 7th. In 2026 it will be May 2nd, the date is irrelevant.
